1. This is the first bail application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant who has been arrested in connection with Crime No. 161/2023 registered at Police Station – Sarsiwan, District Sarangarh- bilaigarh (C.G.), for the offence punishable under Section 302 of IPC. 2. As per the prosecution’s case, the applicant has committed murder of a 35 – 40 years old man by cutting his head from the body with the aid of iron hammer and in order to shield himself from the punishment of murder, the head of the deceased was kept under bamboo poles. Based on this, offence under Section 302 has been registered against the present applicant. 3. 2 and has been falsely implicated in this case. He further submits that the applicant is in jail since 23.05.2023. He further submits that out of 23 witnesses, the prosecution examined 10 witnesses so far. He also submits that trial is going on and it may take some time to conclude. On these premises, he prays for the grant of regular bail to the applicant. 4. On the other hand, learned counsel for the State opposed the bail application and submitted that this is a case of murder and is serious offence, therefore, the applicant does not deserve regular bail. 5. I have heard learned counsel appearing for the parties and perused the case diary. 6. Taking into consideration the entire facts and circumstances of the case, particularly the nature and gravity of the offence and taking into account that the trial is going on, at this stage, I am not inclined to release the applicant on bail. 7. Accordingly, the application filed under Section 483 of B.N.S.S. is rejected.
However, the concerned trial Court is directed to expedite the trial as early as possible. 8. Office is directed to send a certified copy of this order to the trial Court concerned for necessary information and compliance forthwith. Sd/-
