Affidavit of service filed by the petitioner be kept with the record. 2. On 23rd October, 2025 letters of intent for bulk LPG transportation contract by road for the State of West Bengal was issued in favour of the petitioner with respect of the vehicle no. WB41J7124. As per the terms and conditions, the petitioner has to transfer the ownership of the vehicle as well as the PESO license within four months from the date of letters of intent. 3. On 26th February, 2026, the respondent authorities have issued a show cause notice to the petitioner informing the petitioner that the required documents that is registration certificate and PESO license of the vehicle in question has not been transferred within the period of four months from the date of letters of intent and why an action shall not be initiated against the petitioner. 4. The petitioner has submitted the reply to the said show cause notice on 7th March, 2026 informing the
2 authorities that the petitioner has applied for the ownership of the vehicle before the concerned authority in the first week of January, 2026 and ownership of the vehicle has already been transferred in the name of the petitioner on 19th January, 2026. 5. It was also informed that the PESO license has also been transferred in the name of the petitioner on 25th February, 2026. In spite of receipt of this reply and without considering the reply, the respondent authorities have issued the impugned order on 20th March, 2026 by terminating the contract of the petitioner on the ground that the petitioner failed to submit the registration certificate of the PESO license within four months from the date of issuance of the letter of intent. 6.
The learned counsel appearing for the petitioner submits that within the period of four months the registration certificate as well as PESO license has already been transferred in the name of the petitioner and also been informed to the respondent authorities in their reply dated 7th March, 2026 but without considering the same the authorities have passed the impugned order dated 20th March, 2026. 7. The learned counsel for the respondents submits that the authorities have found that the petitioner has not transferred the registration certificate as well as the PESO license within the stipulated period of time. Accordingly, impugned order has been passed terminating the contract of the petitioner. 3
8. Heard the learned counsel for the respective parties. Perused the materials on record. 9. This Court finds that the registration certificate of the vehicle in question has been transferred in the name of the petitioner on 19th January, 2026 and the PESO license is transferred in the name of the petitioner on 25th February, 2026 but the respondent authorities failed to consider the reply to the show cause notice submitted by the petitioner wherein the petitioner categorically informed about the said fact. 10. In view of the above this Court finds that the respondent authorities has issued the impugned order dated 20th March, 2026 without considering that the registration certificate as well as the PESO license has been transferred in the name of the petitioner within the period of four months. Thus the impugned dated 20th March, 2026 is set aside and quashed. The respondent authorities are directed to consider the reply filed by the petitioner alongwith the documents within a period of four weeks from the date of receipt of this order. 11.
