The petitioners are apprehending their arrest in connection with Borio P.S. Case No.63 of 2025, registered for the offence under Sections 115(2), 118(1), 109 and 3(5) of Bharatiya Nyaya Sanhita, 2023, pending in the Court of learned Judicial Magistrate, 1st Class, Sahibganj. 3. Learned counsel appearing for the petitioners submits that there are case and counter case between the parties and the scuffle took place due to getting charge of Madarsa Narul Hoda, Borio. He further submits that some of the persons have come with intention to create hinderance in the flag hoisting ceremony in the said Madarsa. He then submits that petitioner no.1 is a teacher and petitioner no.2 is the brother of petitioner no.1 and they have nothing to do with the said Madarsa. He next submits that the petitioners have got no criminal antecedent as disclosed in paragraph 11 of this application. He also submits that co-accused has been granted anticipatory bail by this Court in A.B.A. No.107 of 2026. ( 2026:JHHC:11809 ) -2- A.B.A. No. 6987 of 2025 4. Learned counsel appearing for the State opposed the prayer and submits that the allegations are there against the petitioners of assault and injury has also been received by the informant. 5. Considering that there are case and counter case and there are general and omnibus allegation of assault against all the accused persons and the petitioner no.1 is a teacher and petitioner no.2 is brother of petitioner no.1 and they have got no criminal antecedent as disclosed in paragraph 11 of this application and co-accused has been granted anticipatory bail by this Court in the aforesaid A.B.A. and in the attending facts and circumstances of the case, I am inclined to extend the privilege of anticipatory bail to the petitioners. 6. Accordingly, the petitioners, above named, are hereby directed to surrender before the learned Court within three weeks from today, and in the event of their surrender/arrest, they shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Sahibganj in connection with Borio P.S.
