None appears for the petitioner. None appears for the State also. Learned advocate for the opposite party no.2 is present. The subject-matter of challenge relates to an order of bail granted on 01.09.2023 by the learned Additional Sessions Judge, Kandi, Murshidabad. Having considered that the bail was granted on 01.09.2023 and more than two years six months have passed since then, I am not inclined to interfere with the prayer for cancellation of bail granted on 01.09.2023. However, if the learned trial court at any relevant stage finds that the accused person is creating obstruction in the progress of the trial and/or are involved in tampering with the witnesses, it would be the discretion of the learned trial court to take an appropriate action against the concerned accused who is involved in such overt acts. The learned trial court at that stage would be at liberty to pass any order(s) and/or cancel the bail which is being enjoyed by the accused person.
2 With the aforesaid observations, CRM (DB) 3768 of 2023 is dismissed. Parties to act on a server copy of this order duly collected from the official website of the Hon’ble High Court, Calcutta.
