1. The instant acquittal appeal has been preferred by the appellant against the impugned judgment of acquittal dated 02.03.2024 passed by learned 6th Additional Sessions Judge, Raigarh (C.G.)

the respondent/accused has been acquitted from the offence under Section 138 of the Negotiable Instruments Act, 1881.

The present appellant was the complainant before the learned trial Court who prosecuted a complaint case under Section 138 of the Negotiable Instruments Act, 1881 against the respondent/accused with the allegation that there was an outstanding amount towards purchase of tractor and agricultural equipments from the complainant concerned and in lieu thereof, the respondent/accused issued a cheque bearing No.641891 which was of Indian Oversees Bank, Raigarh Branch amounting to Rs.5,19,396/- dated 11.04.2016. When the said cheque was presented in the Bank for its clearance, the same was dishonored by the payee Bank on the ground of insufficient funds in the Bank account of the accused. After service of statutory demand notice, a complainant case was instituted by the complainant before the learned trial Court for the offence under Section 138 of the Negotiable Instruments Act, 1881. In the said complaint case, the respondent/accused was convicted by the learned trial Court vide its judgment dated 20.11.2023 and sentenced till rising of the Court and fine of Rs.8,00,000/- (Rupees Eight Lakhs), in default of payment of fine, additional SI for 06 months. The said judgment of conviction and sentence
3 dated 20.11.2023 was challenged by the respondent/accused before the leaned 6th Additional Sessions Judge, Raigarh in Criminal Appeal No.116/2023 which was allowed and the respondent/accused was acquitted by the learned appellate Court which is under challgened in the present acquittal appeal.

Learned counsel appearing for the parties would submit that during the pendency of the present appeal, the parties have amicably settled their dispute before the High Court Mediation Centre on 05.02.2026 and now the complainant does not want to press this complaint further subject to compliance of the conditions of terms and conditions of the compromise. The terms and conditions of the compromise has also been forwarded reproduced in writing by the Mediation Centre on 05.02.2026 and the relevant part of the terms and conditions are reproduced herein below :

1. यहुँ दिक आ$क अंनां$क क बीदिक बीच रशिश रूपय 1,85000/- (एक 23 पचस) हुँजर रूपय) नां हुँ6 जिजसम रूपय
4 4,5000/- (प62)स हुँजर रूपय) आज दिनांक 05.02.2026 क नांक अं दिकय गय हुँ , बीदिक बीच रूपय 1,40000/- (एक 23 च2)स हुँजर रूपय) क 21.04.2026 क अं करग।
2. यहुँ दिक इस समझौ5नांम क प2नां नां दिकय जनां पर उभयपक्ष एक 'सर क दि$रूद्ध भदि$ष्य म कय$हुँ) दिकय जनां क लि2ए $त्र हुँ । उभयपक्ष इस समझौ5 पत्र क श: स सहुँम हुँ6 ए$ प2नां क लि2ए कदिटाबीद्ध हुँ6। समझौ5 पत्र म ) गई श: क उन्हुँ*नां अंपनां) $य क $च्छाप'$क सहुँमति ए$ दिबीनां दिकस) बी$, भय ए$ 22च क $)कर दिकय हुँ । उभयपक्ष नां इस समझौ5 पत्र क श: क पढ़नां $ समझौनां क पश्चा अंपनां) $त्र सहुँमति स परपर एक-'सर क उपस्थिति म हुँक्षर कर दिनांष्पदि दिकय।"
4. Since the parties have entered into compromise and the present is an acquittal appeal filed by the complainant, nothing remains for adjudication in the present acquittal appeal at present. However, the present acquittal appeal is disposed of at this stage subject to fulfillment of the terms and conditions of the settlement arrived at between the parties on 05.02.2026.
