JUSTICE ANAND SHARMA Order 12/03/2026 1. Learned counsel for the petitioners has prayed for following relief in the instant writ petition. It is submitted by learned counsel for the petitioners that the petitioners [2026:RJ-JP:10408] (2 of 3) [CW-3717/2026] participated in the recruitment process on the post of Accountant/ Junior Accountant initiated in the year 2011 however, despite the fact that, there was mandatory rule for preparation of reserve/waiting list, which was to be operated in the event of non- joining of the candidates from the main select list, rule was not followed by the respondents. Under these circumstances, some of the aggrieved persons approached this Court by way of filing S.B.CWP No. 10969/2014 and the other writ petitions which came to be allowed by order dated 25.02.2016 passed by Coordinate Bench of this Court wherein, directions were given to the Administrative Department to send requisition of reserve list to RPSC to the extent of post lying vacant on account of non-joining of the appointees on the post of Accountant. On receipt of requisition, necessary exercise was directed to be carried out. 2. Learned counsel submits that in compliance of order dated 25.02.2016 passed by Coordinate Bench, petitioners were also granted appointment vide order dated 11.01.2017 however, ignoring the fact that the petitioners ought to have been treated as appointee of the vacancies of the year 2012-13, they were treated to be appointee of the year 2016-17. They have prayed for grant of notional benefits of seniority and pay fixation qua those candidates who were appointed pursuant to main select list issued in reference to the very same advertisement. 3. From the perusal of the record, it reveals that no representation whatsoever been filed by the petitioners for seeking redressal of their grievances. Although, learned counsel for the petitioners submits that one legal notice was served upon the respondents however, the alleged legal notice does not bear [2026:RJ-JP:10408] (3 of 3) [CW-3717/2026] any date of issuance, nor any receipt/acknowledgment with regard to such alleged legal notice has been placed on record. 4. Under these circumstances, this Court deems it just and proper to grant liberty to the petitioners to submit a representation with regard to his grievances before the respondent No.2, who shall consider the representation and pass appropriate speaking order strictly in accordance with law within a period of 60 days from the date of receipt of representation along with certified copy of this order. 5.
