Opposite Party(s) Mr. Debaraj Mohanty, AGA CORAM: JUSTICE SIBO SANKAR MISHRA Order No. ORDER 29.04.2026 01. 1. Heard. 2. The petitioner is seeking pre-arrest bail in connection with Narasinghpur P.S. Case No.176 of 2025 corresponding to C.T. Case No.415 of 2025 registered for alleged commission of offences punishable under Sections 126(2)/ 115(2)/ 331(4)/ 305/296/74/351(3) of the BNS, 2023, pending in the Court of the learned J.M.F.C., Narasinghpur. 3. Learned counsel for the petitioner, on instruction from the petitioner, submits that except the present bail application, no other bail application of the petitioner is pending in any other Court relating to the aforesaid F.I.R. p. 2 4. The prosecution story reveals that on 02.11.2025 at about 12 A.M., when the informant along with her two daughters were sleeping in their house, the petitioner entered into her house by breaking her rooftop door and tried to rape the informant for which she raised hulla. On hearing hulla of the informant, her two daughters woke up. The petitioner snatched the gold chain and ear ring from the informant and fled away from the spot. Hence, the case. 5. Learned counsel for the State, on the basis of the written instruction, has pointed out that the petitioner is involved in three more cases and the particulars of those cases are also placed on record. 6. In view of the criminal antecedents of the petitioner, I am not inclined to grant the petitioner anticipatory bail. However, it is open for the petitioner to surrender before the Court below and move for regular bail. If such regular bail application is moved by the petitioner before the Courts below, it is expected that the regular bail application of the petitioner shall p. 3 be considered by the Courts below on the same day on its own merit in accordance with law. 7. With the aforementioned observation, the ABLAPL is disposed of. (S.S. Mishra) Judge Subhasis Designation: Personal Assistant Location: High Court of Orissa, Cuttack.
