Mr. Shubhr Rastogi, learned counsel for the petitioner. 2. Mr. P.S. Bisht, learned Brief Holder for the State of Uttarakhand. 3. Petitioner is resident of Village Ganganauli, Tehsil Laksar, District Haridwar. According to him, Government land has been encroached by private individuals. 4. The reliefs, sought in the writ petition, are as follows:- 1. Issue a writ, order or direction in the nature of Mandamus pleased to direct the respondents to conduct measurement and demarcation of the aforesaid Government/public land recorded as ponds, barren lands and land belongs to manure/compost pits in revenue record situated at Village Gangnauli, Tehsil Laksar, District Haridwar. 2. Issue a writ, order or direction in the nature of Mandamus pleased to direct the respondents to take necessary action to remove the illegal encroachment from the Government Land situated at Village Gangnauli, Tehsil Laksar, District Haridwar in Khasra No. 124, Khasra no. 126, Khata No. 247, Khasra No. 101/6, Khasra No. 120 and Khasra No. 121. 3. Issue a writ, order or direction in the nature of mandamus pleased to direct the respondent authorities to restore the pond and public utility land to its original condition. 4. Issue a writ, order or direction in the nature of mandamus pleased to direct the respondents to take necessary action upon the complaints/representations given by the petitioner. 2026:UHC:4777 5. This Court is not inclined to go into the question whether the allegations made by petitioner in the writ petition are correct or not. However, having regard to the pleadings made in the writ petition, the writ petition is disposed of with liberty to petitioner to make representation to District Magistrate, Haridwar. If he makes representation, along with supporting documents to prove that certain individuals have actually encroached upon Government land, then the District Magistrate shall look into the matter and take decision, as per law, within eight months from the date of presentation of certified copy of this order. It goes without saying that District Magistrate shall hear the persons, likely to be affected by the decision to be taken, before taking any decision.
