1. This is the First bail application filed under Section 483 of the Bhartiya Nagrik Suraksha Sanhita, 2023 for grant of regular bail to the applicant arrested in connection with Crime No. 283/2025 registered at Police Station – Amanaka District – Raipur (C.G.) for the offence punishable under Section 318(4) and 3(5) of BNS.

2 Chandrakar professor in Maitri Dental College Durg lodged report at Amanaka Thana that he was cheated through facebook and Whatsapp group by investing amount Rs.26,68,141/- in the name of share treading indifferent different account. In the present applicant's account as per chargesheet only Rs. 6,10,00/-, it was found that a fraud was committed by any third person by hacking his account which was not used daily basis. On the basis of aforesaid complaint, the police of Police Station - Amanaka, District Raipur (C.G.), registered FIR and investigation was initiated, it was found that the account no. 20100051974129 was in the name of present applicant and Rs. 6,10,000/- was deposited in the said account, hence this bail application.

Learned counsel for the applicant submits that the applicant has been falsely implicated in the present case. It is submitted that the bank account in question was opened in June as a new business account in the name of the registered firm, jointly held by the present applicant and his wife, Habibi Shahanaz. After a few days of opening the account, an amount of ₹6,10,000/- was credited to the said account. The applicant initially believed the amount to be a loan. Upon inquiry with the bank to ascertain the source of the funds, the bank expressed its inability to provide details regarding the transferor. Subsequently, the applicant received a notice from Police Station Amanaka. In response, he voluntarily appeared in Raipur on 03.01.2026, whereupon he was arrested by the police. It is further submitted that an agreement had been executed by
3 the applicant’s cousin brother in the name of the present applicant, wherein a remaining amount of ₹4,10,000/- was agreed to be paid through cheque within a few months. She also submits that the present applicant is in jail since 03.01.2026 and conclusion of the trial may take some time, therefore, he prays for grant of regular bail to the present applicant. 4. On the other hand, the learned State counsel opposes the bail application and submits that applicant has no criminal antecedents. She also submits that as per this Court’s order dated 03.03.2026, concerned Investigating Officer has filed his personal affidavit in the present case. 5. I have heard learned counsel for the parties and perused all of the documents available on record. 6. In compliance of the Court’s order dated 03.03.2026, the Investigating Officer of the subject crime number, Police Station – Amanka, District – Raipur (C.G.), has filed his affidavit showing the incriminating evidence collected against the applicant during the course of investigation, and relevant paragraph of the affidavit is quoted here as under:
“6.That, during the course of investigation, it was found that, the suspect Bandhan Bank Account Number 20100051974129 was found in the name of Dontamala Kishore Kumar, Resident of Kukatpalli, District Medchal, Malkangiri, Hyderabad, Telanghana
4 wherein, 16.07.2025, the amount of Rs. 6.10 Lacs has been on transferred/deposited illegally through cyber fraud/crime from the State Bank of India Account Number 30100406549, Branch at Raipur of the complainant Jayant Chandrakar.

9. That, thereafter, during investigation, the present accused applicant was summoned and questioned
5 and his memorandum statements was taken infront of the relevant witnesses wherein he has categorically deposed that, in June, 2025 he alongwith his wife Habibi Shahnaz have got registered the Firm namely Box Bee Storage Solutions Private Limited situated at Kukatpalli, Hyderabad, Telangana and they are the Directors of the said Firm. The firm leased warehouses for storage purposes. The accused's Bandhan Bank Account Number 20100051974129 is linked to the firm and the accused's mobile number 9000949369 is registered with the aforesaid bank account number. All transactions in the account were handled by the accused. Since the firm was new, the accused needed a loan. Then thorugh is acquaintance's friend, Nani Pathi, a resident of Nizamabad, with mobile number 9848070108, the accused met Manoj Sanga Praveen, a resident of Nizamabad with mobile number 8406059014, who was a bank loan broker. The accused told Nani Pathi and Manoj Sanga Praveen about his firm and they said the firm would only receive a loan if the firm's registered bank account had maximum transactions. They then told the accused to provide the firm's bank documents.
Upon this, the accused provided them with the bank documents and the registered mobile number 9000949369 alongwith the mobile number for two days. Thereafter, they used the aforesaid bank account for many transactions resulting which, his aforesaid bank account was on hold and also for which, the accused received commission. 11. That, during the course of investigation, the present accused applicant was summoned and interrogated regarding the incident wherein, he has
6 categorically admitted that, the applicant colluded with co-accused to provide bank accounts to criminals for executing online frauds and also admitted his involvement explicitly stating that he provided bank accounts for fraudulent activities. 12.That, during the course of investigation, it was revealed that, the present accused applicant has received the aforesaid fraud money in his aforesaid bank account number and he is beneficiary of this case and obtained money earned from the cyber fraud/crime. That, cogent evidence of criminal transactions has been found from the mobile and bank accounts of the accused applicant, therefore, it is clear from the actions of the accused applicant that, he is a member of an organized Cyber Fraud/Crime Gang.”
7. I have heard learned counsel for the parties and perused the case diary. 8. Taking into consideration the facts and circumstances of the case, and upon perusal of the case diary, it is noted that the applicant has no prior criminal antecedents. However, the investigation reveals that an amount of ₹6.10 lakhs was illegally transferred/deposited through cyber fraud. It is further observed that multiple complaints have been registered against the aforesaid bank account on the National Cyber Crime Reporting Portal (1930) by victims residing in various states across the country. Moreover, the material on record indicates that the applicant colluded with co-accused persons by providing bank accounts to facilitate the commission of online frauds. The
7 applicant has also admitted his involvement, explicitly stating that he provided bank accounts for fraudulent activities. 9.
Accordingly, this bail application of applicant – Dontamala Kishore Kumar involved in Crime No.283/2025 registered at Police Station – Amanka District – Raipur (C.G.) for the offence punishable under Section 318(4) and 3(5) of BNS, is rejected at this stage. 10. Needless to say that the trial Court concerned is at liberty to proceed and conclude the trial expeditiously. 11.
