This C24 application has been filed with the prayer to transfer Original Case No.421 of 2025, “Ashish Kumar Singh vs. Shweta Singh”, filed under Section 25(i)(ii) of the Uniform Civil Code of Uttarakhand Act, 2024, pending before the Court of Principal Judge, Family Court, Dehradun to Principal Judge, Family Court, Haridwar. 3. Learned counsel for the applicant submits that respondent is husband of the applicant and their marriage was solemnized on 18.02.2017; that, the applicant gave birth to a male child, namely Aadik Singh on 19.12.2023; that to take care of her and her child she came to her parental house by permission of her husband; that, just to harass the applicant the respondent filed the Original Case No. 421 of 2025 before the court of Principal Judge, Family Court, Dehradun; that, the applicant is residing with her parents at Najibabad along with 1 2026:UHC:4753 her minor son and on each and every date the applicant has to go along with her father to Dehradun from Najibabad which takes 03 hours, so it is very difficult for her to attend the court at Dehradun on each and every date of hearing; that Haridwar is at only one hour distance from Najibabad, therefore, the aforesaid Original Case should be transferred to Haridwar. 4. Learned counsel appearing for the respondent has filed objections to the transfer application however he does not dispute that the applicant is having a minor son and is residing at her parental house. In the transfer application an interim order was passed on 09.04.2025 and the transfer application is pending for the last one year and as such the learned counsel for the respondent submits that in case the transfer application is decided by this Court then directions may be issued for early disposal of the case. 5. In view of the fact that applicant is facing undue hardship the instant C24 application is allowed. The Original Case No.421 of 2025, “Ashish Kumar Singh vs. Shweta Singh”, pending before the Court of Principal Judge, Family Court, Dehradun is directed to be transferred to Principal Judge, Family Court, Haridwar. The learned Court is directed to hear and decide the case as expeditiously as possible. 6. As a sequel thereto, the miscellaneous application, if any, shall also stands disposed of. 7.
