06/21.04.2026 Heard the learned counsel appearing on behalf of the parties.

Learned counsel for the petitioner submits that the petitioner is in custody since 14.08.2025 in connection with Special POCSO Case No. 71 of 2025 arising out of Chandrapura P.S. Case No. 76 of 2025 for the offences registered under Sections 137(2), 3(5) of Bharatiya Nyaya Sanhita, 2023 and amended section 69 of Bharatiya Nyaya Sanhita, 2023 and section 4/12 of POCSO Act, 2012, pending in the court of learned District and Additional Sessions Judge-III-cum-Special Judge (POCSO Act), Bokaro.

Learned counsel for the petitioner submits that the case is of adolescence love and the petitioner has been falsely implicated in this case.
4. The informant, father of the victim, has opposed the prayer and has submitted that the victim has been examined before the court and she has supported the prosecution case of forceful intercourse. He also submits that the petitioner is 24 years of age and the victim is 15 years of age.

Learned counsel for the State has submitted that altogether 6 witnesses have already been examined out of 12 witnesses and the remaining witnesses can be produced at the earliest.

6. To this the learned counsel for the petitioner has submitted that the next date of trial is 04.05.2026.
2. After hearing the learned counsel for the parties and considering the direct allegations made against the petitioner, this court is not inclined to enlarge the petitioner above named on bail. Accordingly, prayer for bail of the petitioner above named is rejected.
3. However, the State is directed to ensure that the remaining witnesses promptly produced including at least on 04.05.2026.
4. The learned counsel for the State is directed to communicate this
order to the Director, Prosecution and also to the Superintendent of Police of the concerned district to ensure compliance.
5. Let this order be communicated to the court concerned through FAX/e-mail.
