After arguing for some time, Mr. Karan Anand, learned counsel for the applicant wishes to withdraw the present application under Section 482 of the Cr.P.C. with liberty to file an appeal against the acquittal. He further prays that in case, he files a fresh appeal against acquittal, the delay of two years, which would be chanced in preferring the appeal may be considered sympathetically. 4. Since the present Application under Section 482 Cr.P.C. has been filed under misconception that the application under Section 482 Cr.P.C. would lie against the dismissal of a complaint under Section 138 of the N.I. Act and the same has remained pending before the Court for the last almost two years, hence, the delay which has chanced deserves to be considered sympathetically. 5.
