02 /10.03.2026: This bail application has been filed under Sections 483 & 484 of BNSS, 2023 wherein, prayer has been made for grant of bail as he is in custody for allegedly committing offence punishable under Sections 406 and 420 of the Indian Penal Code.
2. Heard, learned counsel for the petitioner, learned counsel for the State and have also gone through the impugned order.
3. Learned APP opposes the prayer for bail.
4. The case of the petitioner was earlier rejected on merits. Now the petitioner renews the prayer stating that PW 5 and PW6 who are the loanees have stated that they have no grievance against this petitioner as the loan amount has already been deposited. This is a case of defalcation where the petitioner is the manager. It is alleged that the petitioner has collected the money from the loanees but has not deposited in the account.
5. Considering the allegation that the petitioner even after collecting the money has not deposited the amount and the trial is in progress, at this stage, I am not inclined to grant privilege of bail to the petitioner. Accordingly, the prayer for bail of the petitioner in connection with Gumla PS Case No. 185 of 2024 corresponding to GR No. 442 of 2025, pending in the Court of learned Chief Judicial Magistrate, Gumla stands rejected.
