1. Petitioner has filed this petition seeking following relief (s) :-
“10.1 Issue a Writ of Certiorari or any other appropriate Writ, order, or direction, calling for the records of the case and quashing the impugned Suspension Order BALRAM PRASAD DEWANGAN Digitally signed by BALRAM PRASAD DEWANGAN
2 dated 26/11/2025 (Ann.P-13), passed by the Respondent No. 4. 10.2 Issue a Writ of Mandamus or any other appropriate Writ, order, or direction, directing the Respondents, particularly Respondent No. 4, to forthwith release the full and complete salary of the Petitioner for the months of September, October, and November 2025, along with any consequential arrears and interest. 10.3 Issue a Writ of Mandamus or any other appropriate Writ, directing the Respondents to reinstate the Petitioner to his original post and posting location at Sub-Health Center C.B. Navagaon, Block Daundi Lohara, with all consequential benefits. 10.4 To grant any other relief or reliefs as this Hon'ble Court may deem fit and proper in the facts and circumstances of the case.
2. Learned State counsel raised an objection on the maintainability of the writ petition on the ground that petitioner is having efficacious alternate remedy of appeal under Rule 23 of the Chhattisgarh Civil Services (Classification, Control and Appeal) Rules, 1966 (In short ‘the Rules, 1966’).

Learned counsel for petitioner, however, submits that order of suspension is passed only when petitioner claimed salary of three months.

Considering the submission of learned counsel for parties, further considering that order of suspension (Annexure P-13) against which writ petition is filed, is appealable under Rule 23 of the Rules, 1966, I am not inclined to entertain this writ petition. Accordingly, this writ petition is disposed of reserving liberty to petitioner to prefer an appeal as provided under Rule 23 of the Rules, 1966 and if such an appeal is
3 filed by petitioner, concerned authority shall consider and take decision on the appeal against the order of suspension within further period of 45 days from the date of filing of appeal.
5. With the aforesaid observations and directions, this petition stands
