Represented by Adv. – U.C. Jena, A.S.C.
CORAM:
THE HON’BLE MR. JUSTICE ADITYA KUMAR MOHAPATRA
ORDER 23.04.2026
Order No.
01.
1. This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).
2. Heard learned counsel appearing for the Petitioner and learned Additional Standing Counsel appearing for the State- Opposite Party. Perused the bail application as well as the F.I.R and other documents attached to the bail application.
3. The present bail application under Section 483 of B.N.S.S has been filed by the Petitioner for regular bail in connection with S.T Case No.05 of 2026, arising out of Lakhana P.S Case No.129 of 2025, pending in the Court of learned District & Sessions Judge, Nuapada for alleged commission of offence punishable under Sections 143(3)/ 318(2) of the BNS, 2023 read with Section 25 of the ISMW (RE&CS) Act, 1979.
4.
Learned counsel for the Petitioner submits that earlier this matter was not before any other Bench of this Court. It is submitted
Page 2 of 3. by the learned counsel for the Petitioner that the Petitioner is in custody since 25.01.2026 in connection with the abovenoted case. He further submitted that in the meantime the investigation has been concluded and the final charge sheet has been filed. Learned counsel for the Petitioner further submitted that there is no possibility of the trial being started in the near future. He further submitted that although the Petitioner is having two similar criminal antecedents, however, the Petitioner is ready and willing to abide by any stringent terms and conditions.
5. In course of argument, learned counsel for the Petitioner brought to the notice of this Court that the earlier bail application of the Petitioner bearing BLAPL No.169 of 2026 was rejected by a Coordinate Bench vide order dated 19.02.2026 by granting liberty to the Petitioner to renew his prayer under the changed circumstance of submission of charge sheet. Such rejection order was prior to filing of charge sheet. In the meantime, the charge sheet has been filed, therefore, the Petitioner has once again approached this Court by filing the present bail application challenging the impugned rejection order dated 23.02.2026.
6. Learned Additional Standing Counsel for the State on the other hand objected to the release of the Petitioner on bail on the ground of gravity and seriousness of the allegation. He further contended that the Petitioner is a habitual offender and that in the event he is released on bail there is every likelihood that he might indulge in similar criminal offences. On such ground, learned counsel for the State objected to the release of the Petitioner on bail.
7. Having heard the learned counsels appearing for the

facts as well as materials on record, further taking note of the fact that the investigation has been concluded and the final charge sheet has been filed, further keeping in view the period of custodial detention, this Court is inclined to release the Petitioner on bail subject to imposition of stringent conditions.
8. Hence, it is directed that the Petitioner be released on bail in the aforesaid case on furnishing a bail bond of Rs.50,000/- (Rupees Fifty thousand) with two solvent sureties each for the like amount to the satisfaction of the learned court in seisin over the matter. Release of the petitioner shall also be subject to a condition that he shall not indulge in similar criminal of offences while on bail; shall not leave the jurisdiction of the court in seisin over the matter without prior permission of the court in seisin over the matter; shall not default in attending before the court during trial on each date of posting, unless his personal appearance is dispensed with by the learned trial court. Violation of any of the conditions shall entail cancellation of the bail application.
9. The BLAPL is, accordingly, disposed of.
