Mr. Prateek Singh Thalur, Advocate would confine his submission pertaining to relief clause 10.2 of the writ petition, which reads as under :- “10.2 That, respondents be directed to consider the name of the petitioner for promotion to the post of Assistant Grade III considering his seniority in the gradation list issued on 01.04.2016 with all consequential benefits.” 2. Learned counsel for the petitioner would submit that initially the petitioner was appointed as waterman in the year 1991 under the respondent No. 4. He would further submit that thereafter, the petitioner was appointed to the permanent post of peon, but till date his name has not been considered for promotion to the post of Assistant Grade III (A.G. III). He would also submit that juniors to the petitioners have already been promoted to the post of A.G. III, therefore, a direction may be issued to respondent authorities to consider the claim of the petitioner for promotion, strictly in accordance with the law within stipulated time. 3. On the other hand, Mr. Amandeep Singh, Panel Lawyer appearing for the State would oppose. He would submit that the claim of the petitioner was considered by the department and as he was lacking merit, therefore, he was not found suitable for promotion to the post of A.G. III. He would further submit that time bound pay scale has already 3 been granted to the petitioner. He would contend that the instant petition deserves to be dismissed. 4. I have heard learned counsel for the parties and perused the documents placed on record. 5. Considering the submission made by the respective Advocates, without expressing any opinion on the merits of the case, this petition is disposed of reserving liberty in favour of the petitioner to make a representation before respondent No. 4 within a period of 30 days, and in turn, the said authority is directed to consider the claim of the petitioner for grant of promotion to the post of A.G. III, strictly in accordance with the law, preferably within a period of 90 days from the date of receipt of copy of this order. 6.
