JUSTICE RAJESH KUMAR For the Petitioner(s) : Mr. Ritu Raj, Advocate For the O.P.- State : Mr. Abhay Kumar Tiwari, A.P.P. 02/17.04.2026 The present Cr.M.P. has been filed for modification of the order dated 18.10.2024 passed in B.A. No. 7724 of 2024 with regards to the conditions imposed by the Court while granting regular bail to the applicant namely Anil Kumar Das. 2. Learned counsel for the petitioner has submitted that the applicant Anil Kumar Das was granted regular bail by this Court vide order dated 18.10.2024 with conditions i.e., “one of the bailors will be the pairwikar and the applicant(s) will report to the concerned police station once in a month till the conclusion of trial.” 3. It has been further submitted by the learned counsel for the petitioner that in the instant case cognizance has been taken on 07.10.2024 and charge has been framed on 14.11.2024. Now the case is at the stage of evidence of witnesses, however, out of 9 charge- sheeted witnesses, not a single witness has been examined. Further, it has been submitted that petitioner was working as Security Guard in Bangalore for earning his livelihood and after he was taken into custody, he has lost his job and present he is working as Security Supervisor under Security and Vigilance, Service, Ramjaypal Nagar, Bailey Road, Patna and regularly appearing before the concerned Police Station once in a month and also attending before the learned Trial Court. He has got no criminal antecedent and, as such, being a married person having three children, he is facing great hardship in attending the concerned Police Station once in a month. Petitioner has been attending the concerned Police Station and cooperating in the Trial since November 2024. 2026:JHHC:11002 2 Cr.M.P. No. 827 of 2026 4. Therefore, it has been prayed by the learned counsel for the petitioner that the order dated 18.10.2024 passed in B.A. No. 7724 of 2024 may be modified by waiving off the condition regarding reporting to the concerned police station once in a month till the conclusion of trial so that he can earn his livelihood and also appear before the learned Trial Court. Petitioner is ready to abide by all the terms and conditions as has been imposed by this Court. 5. Having considered the submission of the learned counsel for the petitioner and the reason assigned in the present Cr.M.P., the order dated 18.10.2024 passed in B.A. No. 7724 of 2024 is modified up to the extent by waiving off the condition “applicant(s) will report to the concerned police station once in a month till the conclusion of trial”.
