JUSTICE DEVASHIS BARUAH ORDER 20.05.2026 Heard Mr. R Sarma, the learned counsel appearing on behalf of the petitioner. Also heard Mr. R Talukdar, the learned Government Advocate, Assam. 2. The petitioner, who is a registered owner of a Travel Agency namely Trivandam Transport is carrying on a business of giving vehicles on hire. The petitioner is aggrieved by the non-release of the Page No.# 3/6 hire-charge bill to the petitioner which was hired by the respondent authorities on various dates for maintaining law and order for the period from 01.01.2023 till 30.06.2025. At paragraph No.12 of the instant writ petition, the petitioner states that the petitioner is entitled to an amount of Rs.35,80,208/-, for the various periods, w.e.f. 01.01.2023 till 30.06.2025 the details of which have been given in the form of a table at paragraph No.10 to the writ petition. On account of the non-payment of the hire-charge bills, the petitioner has approached this Court by filing the present writ petition. 3. This Court vide the order dated 06.03.2026 issued notice seeking a response from the respondent authorities. In pursuance thereto, a communication/para-wise comment dated 20.04.2026 has been placed by the Deputy Commissioner of Police (Crime), Guwahati, Assam which is kept on record and marked with the letter ‘X’. In the said para-wise comment, at paragraph Nos.8 and 9, it is mentioned that the bills for the period from 01.01.2023 till 30.06.2025 of an amount of Rs.34,44,678/- have been verified and sent to the Assam Police Headquarters to accord financial approval and release of funds. Paragraphs Nos.8 and 9 of the said para-wise comment so produced before this Court being relevant are quoted hereinunder: “8. That with regard to the statement made in paragraph-12 of the Writ Petition, the answering deponent begs to state that the petitioner has made claimed for an amount of Rs.35,80,208/- (Thirty-five lakhs eighty thousand two hundred eight) only as Page No.# 4/6 outstanding dues. To ascertain the correctness of the claims, matter needs to be examined with the concerned available records: - The facts reveal from the examination of the records; it is found that the petitioner firm has submitted 17 (seventeen) numbers of hire charges bills for the hiring of the vehicle's numbers noted above on various dates during the period from 2023 to 2025. The details are as follows: - (i) Records reveals that an amount of Rs. 1,35,530/- against 1 (one) number of bill for the period from 01.10.2023 to 31.11.2023 has already been credited to the Bank Account of the petitioner vide bill No. 02580 dated 16.03.2026. (ii) The 16 (sixteen) numbers of bills pertaining to the amount of Rs.34,44,678/- have been duly scrutinized with the records available and thereafter forwarded to Assam Police Headquarters to accord financial approval. That with regard to the statement made in paragraph – 13 of the Writ Petition, the answering deponent begs to state that bills pertaining to the amount of Rs. 34,44,678/- have already been forwarded to the Assam Police Headquarters to accord financial approval. It is further stated that the matter related to the release of fund always depend upon the Govt., which are yet to be received and as such the outstanding dues payable to the petitioner against the proposals amount are pending.” 4. It is the opinion of this Court that as the amount of Rs.34,44,678/- has been duly verified and it is found that the petitioner is entitled for the period from 01.01.2023 till 30.06.2025, appropriate directions can be issued to the respondent authorities for payment within a reasonable period. 5. Accordingly the instant with petition stands disposed of with the following observations and directions: (i). The respondents herein jointly and severely are directed to pay the amount of Rs.34,44,678/- to the petitioner within a period of 6(six) months from the date a certified copy of the instant order is served upon the respondent No.7 i.e. the Director General of Police, Assam.
