Department, dated 09-06-2022 in issuing Article of Charges and the Government vide Memo No. 887/SEC IV/Al/2018-4 E.F.S. and T. SEC(IV) Department dated 01-01-2019 according sanction for initiating departmental proceedings under Clause (b) of Sub-Rule 2 of Rule 9 in utter violation of A.P.Revised Pension Rules, 1980 without power and authority and contrary to the law laid down by the Hon'ble Supreme Court of India in 1) M.V.Bijlani 2 Case reported in (2006) 5 SCC 882) P.V.Mahadevan Case reported in (2005) 6 SCC 63611) N.Radhakishan Case reported in (1998) 4 SCC 1and in violation of Articles 14, 16 and 21 of the Constitution of India and consequentially quash the Article of Charges of the Government vide Memo No. 887/SEC IV/A1/2018-4 E.F.S. and T. GP FOR SERVICES IV The Court made the following: 3 THE HONOURABLE SRI JUSTICE TARLADA RAJASEKHAR RAO WRIT PETITION No.25791 of 2022 ORDER:- The present Writ Petition is filed to set aside the G.O.Rt.No.54, E.F.S. & T. Department dated 09.06.2022, wherein the 2nd respondent has issued a sanction for initiating departmental proceedings under Clause (b) of sub-rule (2) of Rule 9 of the A.P.Revised Pension Rules, 1980 on the ground that it is in violation of the A.P.Revised Pension Rules, 1980. 2. The 1st respondent filed counter affidavit and at paragraph No.7 it has been stated as follows: "7. It is respectfully submitted that, the Government have examined the matter based on the material made available and issued orders in Memo.No.887/Sec.IV/A1/ 2018, EFS&T (Sec.IV) Department, dated 09.11.2023, withdrawing the disciplinary proceedings issued against Sri L.Ch.Thirupelu Reddy (petitioner herein) and Sri B.Vijaya Ratnam, Forest Section Officer (Retired on 28.02.2018), formerly worked as Forest Section Officer, Sankhavaram Section, Yeleswaram Range of Kakinada Division of Rajahmundry Circle vide Memo.No.887/ Sec.IV/A1/2018-4, EFS&T (Sec.IV) Department, dated 01.01.2019 as well as Articles of Charges issued against them in G.O.Rt.No.54 & 55, Environment, Forests, Science & Technology (Sec.IV) Department, dated 4 09.06.2022, respectively and dropping further action in the matter and initiating criminal action against them as there is no feasibility to take disciplinary action against them." 3. As the respondents have not intended to proceed further in the disciplinary proceedings, nothing survives in the present Writ Petition to adjudicate further. 4. Accordingly, the Writ Petition is closed. There shall be no order as to costs.
