JUSTICE ANANT RAMANATH HEGDE ORAL ORDER This petition is filed to quash the order dated 01.12.2023 marked at Annexure-K and also the order dated 22.05.2024 marked at Annexure-M. 2. In terms of order at Annexure-K, the respondent- Corporation has requested the jurisdictional Medical Board to examine the petitioner and to give report on 10 points specified in the said letter at Annexure-K. 3. In terms of Annexure-M, which is addressed to the petitioner, the respondent-Corporation has directed the petitioner to report to duty. This order is passed by taking into consideration the Disability Certificate. The petitioner is before this Court assailing the said two orders. - 3 - HC-KAR NC: 2026:KHC:17035 WP No. 15476 of 2024 4. Learned counsel for the respondent submits that the petitioner has not reported to duty since January, 2026. 5. Learned counsel for the petitioner submits that though the petitioner had approached the Medical Board for medical examination, the Medical Board has refused to examine the petitioner and assess the disability, on the premise that there is no such order or direction by the employer. 6. The Court has considered the contentions raised at the Bar and perused the records. 7. It is submitted that the Disability Certificate earlier issued to the petitioner was valid for two years from 05.02.2023. It is stated that the said certificate was valid for two years. 8. This being the position, the Court is of the view that, the petitioner has to subject himself for medical examination. After the Medical Board examines the petitioner and assess his alleged disability, appropriate orders and directions by the employer would follow. 9. Hence, the following: - 4 - HC-KAR NC: 2026:KHC:17035 WP No. 15476 of 2024 ORDER (i) Writ petition is allowed in part; (ii) The petitioner shall approach the respondent and collect the order for medical examination by the respondent-employer; and (iii) The employer shall issue a letter to the petitioner to subject the petitioner for medical examination.
