Affidavit-of-service filed by the petitioner is kept with the record. Petitioner has prayed for a direction upon the 2nd respondent, i.e., the District Land and Land Reforms Officer, South 24 Parganas, to consider and dispose of the representation of the petitioner dated January 27, 2013 filed under Section 9 of the West Bengal Acquisition of Homestead Land for Agricultural Labourers, Artisans and Fishermen Act,
1975. The 1975 Act is a specified Act under Section 2(r) of the West Bengal Land Reforms and Tenancy Tribunal Act, 1997. Petitioner has alleged inaction on the part of the authorities under the specified Act.
2 Since an alternative and efficacious remedy is available under the 1997 Act, this Court is not inclined to entertain this writ petition. According this writ petition stands disposed of leaving the petitioner free to approach the appropriate forum in accordance with law. It is, however, made clear that this Court has not gone into the merits of the claim made by the petitioner in this writ petition and all points are left open to be decided by the appropriate forum if such forum is approached by the petitioner.
