This is the first bail application filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’) for grant of anticipatory bail to the applicant in connection with Crime No.11/2026 registered at Police Station- Narayanpur, District- Jashpur (C.G.) under Digitally signed by AMIT PATEL Digitally signed by AMIT PATEL 2 Section 4, 6, 10 of Chhattisgarh Pashu Parirakshan Adhiniyam Act, 2004. 2. The case of the prosecution, in brief, is that on 02-02-2026, at around 3:00 a.m., some individuals were taking 32 cattle to a slaughterhouse in Jharkhand via Bachhraon, beating them with sticks. It is alleged that Silphi, Zuber, Yusuf Ansari, and others were offered Rs. 1,000 each for transporting the cattle from Kajra Dhongaghat to Beltoli; accordingly, they took the 32 cattle to Beltoli, after which other persons took the cattle towards the slaughterhouse in Jharkhand. Thereafter the matter was registered against the applicant. 3. Learned counsel for the applicant submits that the applicant has been falsely implicated in the present case and is wholly innocent. It is further submitted that the applicant neither committed nor participated in the alleged offence, the applicant was merely a pedestrian and had no direct role in transporting the cattle towards the slaughterhouse. The applicant had no involvement in transporting the cattle towards the slaughterhouse and has been arrayed as an accused solely on the basis of suspicion. He further submits that applicant has no criminal antecedents and there is no material available against the applicant proving his guilt in the aforesaid offence. Trial is likely to take substantial time and therefore, he prays for grant of anticipatory bail to the present applicant. 4. On the other hand, learned State counsel vehemently opposes the prayer for grant of anticipatory bail and submits that the offences registered against the applicant are serious and therefore, it is 3 submitted that the anticipatory bail application of the applicant deserves to be rejected. 5. I have heard learned counsel appearing for the parties and perused the case diary. 6. Considering the facts and circumstances of the case, the nature and gravity of the allegations leveled against the applicant, and specifically the fact that the applicant was merely a pedestrian and had no direct role in transporting the cattle towards the slaughterhouse, at this stage without expressing any opinion on merits, this Court is of the view that the applicant is entitled to be granted anticipatory bail in this case. 7. Accordingly, the instant MCRCA is allowed and it is directed that in the event of arrest of the applicant –Mohd. Masud Ansari on executing a personal bond and one surety in the like sum to the satisfaction of the arresting Officer, he shall be released on bail on the following conditions:- (a) The Applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade her from disclosing such fact to the Court. (b) The Applicant shall not act in any manner which will be prejudicial to fair and expeditious trial. (c) The Applicant shall appear before the trial Court on each and every date given to her by the said Court till disposal of the trial. (d)The Applicant and the surety shall submit a copyof their adhaar card alongwith a colored postcard full size photo having printed the adhaar number on it, which shall be verified by the trial Court. 4 (e)The Applicant shall not involve himself in any offence of similar nature in future.
