The accused/applicant has moved this first bail application under Section 483 of BNSS, 2023, for releasing him on regular bail during trial in connection with Crime No. 88/2024 registered at Police Station – Nagri, District – Dhamtari (C.G.) for the offence punishable under Section 103(1) of Bharatiya Nyaya Sanhita, 2023 (hereinafter referred to as the, “BNS”)
2. Case of the prosecution, in brief, is that on 06.11.2024 at about 10:00 PM, deceased- Shatrughan Nishad, entered the house of the accused PRIYANKA VERMA Digitally signed by PRIYANKA VERMA Date: 2026.04.23 17:14:20 +0530
2 to steal paddy. Accused- Ravi Majhi @ Golu, caught hold of him and slapped him, whereupon the deceased allegedly assaulted the accused with a stone. Thereafter, the accused took him outside and assaulted him with fists and kicks. The deceased was taken to hospital, where he was declared dead. Based on the said report, the police registered the offence against the applicant, leading to his arrest. 3. Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated in the case. He submits that there is no eye-witness to the incident. He further submits that even if the prosecution case is taken altogether, the evidence does not make out a case of culpable homicide. Lastly, he submits that the applicant is in jail since 08.11.2024, therefore, he may be released on bail. 4. On the other hand, learned State counsel opposes the bail application and submits that the applicant is charged under Section 103(1) of BNS for committing murder of deceased- Shatrughan Nishad. She submits that out of 16 witnesses, 8 have been examined so far. She further submits that appreciation of evidence is not required at this stage as the trial is in progress and therefore, prays for dismissal of the application. 5. I have heard learned counsel for the parties and perused the case diary. 6.
Considering the facts and circumstances of the case, particularly the nature and gravity of the offence and further considering that the trial is in progress, I am not inclined to release the applicant on bail. 7. Accordingly, the bail application filed under Section 483 of BNSS, 2023 is rejected. 3
8. Office is directed to sent a certified copy of this order to the trial Court concerned for necessary information and compliance forthwith. Sd/-
