Pundir, learned Dy.A.G. with Mr. Sushil Vashisth, learned Standing Counsel for the State- respondent nos.1 to 5. 3. Mr. Deep Chandra Joshi, learned Counsel for respondent no.6. 4. Petitioner is serving as Agriculture and Soil Conservation Officer. He was posted at Roorkee, District Haridwar. Vide order dated 29.06.2024 passed by Director General, Agriculture and Horticulture Department, petitioner was transferred to the Directorate of Agriculture at Dehradun, by holding that Haridwar is his home district, and as per the provisions of Uttarakhand Annual Transfer for Public Servants Act, 2017, a Member of Group ‘A’ and Group ‘B’ service cannot be posted in his home district. 5. This Court, vide order dated 05.07.2024, had stayed the effect and operation of transfer order dated 29.06.2024. Nearly two years have gone by after passing of said order. The writ petition cannot be kept pending for an indefinite period. 6. Having regard to the facts and circumstances of the case, present writ petition is disposed of with liberty to petitioner to make representation to the 2026:UHC:4715-DB transferring authority. If he makes representation within two weeks, transferring authority shall take decision thereon within four weeks thereafter. For a period of six weeks or till decision is taken, whichever is earlier, status quo shall be maintained in respect of posting of petitioner. 7. Pending application, if any, stands disposed of.
