Learned senior advocate appearing for the petitioner submits that petitioner is in custody for more than ten months and he has been falsely implicated in the instant case for alleged recovery of 35 kgs of ganja. Learned advocate for the State opposes the prayer for bail and submits that petitioner took the vehicle for carrying the contraband. Having considered the facts of the case, at this stage, I am not inclined to release the petitioner on bail as rigor of Section 37 of the NDPS Act is attracted. Petitioner would be at liberty to approach this after the evidence of seizure list witnesses are over. Prosecution is directed to give priority to the seizure list witnesses preferably within a period of three months. 2 Accordingly, CRM (NDPS) 467 of 2026 is dismissed at this stage. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
