Counsel for the State has pointed out that the writ petitioner was appointed afresh against a vacant post on 05.08.2013 (Annexure R-2), as a Trainee Electrician on temporary basis and on an earlier occasion, the petitioner had been working as a contractual employee under CDC Scheme from 17.01.1996. He further submits that directions have now been issued to regularize his services after having completing five years service from the date of initial appointment, as has been done in the case of Smt. Rajni Sharma, whereas actual benefits have been restricted to three years prior to filing of the writ petition. Counsel for the State seeks time to obtain instructions as to the status of the other nine employees detailed in office order dated 05.08.2013 (Annexure R-2). In such circumstances, we are of the considered opinion that since the delay in filing the appeal is only of 8 days and the application is duly supported by the affidavit of the official, therefore, the delay of 8 days is condoned.
