1. Mr. Hari Mohan Bhatia, learned counsel for the applicants.
2. Mr. Jitendra Chaudhary and Mr. Kishore Rai, learned counsel for the respondents.
3. The present application has been filed under Section 11(6) of the Arbitration and Conciliation Act, 1996 for appointment of an Arbitrator to resolve the disputes and differences between the parties arising out of a Partnership Agreement dated 08.07.1993.
2. Counsel for the respondents does not dispute that Clause 19 of the Partnership Agreement contains an arbitration clause. He also does not have any objection in the appointment of the arbitrator.
3. Accordingly, the Court proposes the name of Hon’ble Mr. Justice Subhash Chand, Former Judge, Allahabad High Court/ Jharkhand High Court, Resident of C47 Sharda Nagar Colony, Mandir Wali Gali, Jwalapur, District Haridwar, as arbitrator to decide the disputes and differences between the parties arising out of the Partnership Agreement.
4. Let necessary disclosures and consent in terms of Section 11(8) of the Act be obtained from the Arbitrator within two weeks and thereafter the matter be listed for further orders before the Court.
