For Petitioner(s): Mr. N .R.Anantha Rama Krishna For Respondent(s): Mr.R. Thiagarajan __________ Page6 of 10 https://www.mhc.tn.gov.in/judis CRP No. 904 of 2026 ORDER This Civil Revision Petition has been filed challenging the order passed by the Trial Court, dismissing the application filed by the petitioner seeking her impleadment in the suit as party/defendant. 2. The respondents 1 to 5 herein/ plaintiffs filed a suit for partition against other respondents. The petitioner herein, claiming herself as a daughter of one V.Baskaran, who was arrayed as 28th defendant in the suit, filed the instant application seeking her impleadment in the suit as a party/defendant. The Trial Court by impugned order, dismissed the above said application on the ground that the petitioner failed to establish that she is a daughter of 28th defendant. Aggrieved by the same, the petitioner has come before this court. 3. The learned counsel for the petitioner would submit that the petitioner is the daughter of 28th defendant, namely V.Baskaran, who is entitled to 1/30 share in the suit property. He would further submit that there was a misunderstanding between the petitioner and her father 28th defendant V.Baskaran, who deserted the petitioner and her mother and therefore, the petitioner shall be impleaded in the suit as a party defendant. 4. It is seen from the typed set of papers that the impleading application was opposed by the respondents on the ground that the petitioner is not the __________ Page7 of 10 https://www.mhc.tn.gov.in/judis CRP No. 904 of 2026 daughter of V.Baskaran. Though the petitioner filed her Adhar card, Transfer Certificate, Pan Card, Mark sheets, etc., in support of her claim, in all these documents, the name of her father is mentioned as V.Janakiraman, however, the petitioner claims that she is daughter of V.Baskaran, who was arrayed as 28th defendant in the suit. It is the case of the petitioner that V.Baskaran, who was arrayed as 28th defendant and the father of the petitioner V.Janakiraman are one and the same person and to establish the same, she relies on a bail order passed in Crl.O.P.No.4557 of 2007 dated 21.02.2007, wherein, the first petitioner’s name is mentioned as V.Baskaran @ V.janakiraman. The Trial Court rejected the petitioner’s claim on the ground that merely based on bail order, one cannot come to the definite conclusion that V.Baskaran also known as V.Janakiraman. There is a serious dispute among the parties with regard to the legal status of the petitioner, whether she is daughter of V.Baskaran or not. Further, in the affidavit filed in support of the impleading application, the petitioner has not stated that there was a misunderstanding between her and her alleged father V.Baskaran and he is acting against her interest. In the absence of pleadings that the alleged father of the petitioner is acting against her interest, impleadment of the petitioner as a party defendant in the suit is not required. It is also seen that the suit for partition was of the year 2014 and the trial has come to the fag end and now DW7 is in the witness box. In such circumstances, the Trial Court rightly dismissed the application fled by the petitioner and I do not find any irregularity or illegality in the said order. __________ Page8 of 10 https://www.mhc.tn.gov.in/judis CRP No. 904 of 2026 5. Accordingly, this civil revision petition is dismissed. The dismissal of the civil revision petition will not come in the way of the petitioner exploring other remedies available under law. There shall be no order as to costs. Connected miscellaneous petition is closed. 24-02-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No MST To The I Additional District and Sessions Judge, Tiruvallur. __________ Page9 of 10 https://www.mhc.tn.gov.in/judis CRP No. 904 of 2026 S.SOUNTHAR, J.
