1. The instant bail application has been filed under Section 483 BNSS on behalf of accused-applicant. The accused-applicant was arrested in connection with FIR No. 77/2026 registered at Police Station Shahpura (Jaipur Rural) District Jaipur Rural for the offence(s) under Sections 8/20 of N.D.P.S. Act.

Learned counsel for the accused-applicant submits that the applicant is old man aged 46 years. It is submitted that the accused-applicant is sole bread-earner of his family, having no criminal antecedents registered against him. It is submitted that the recovered contraband i.e. ganja is 1.790 Kg, which is less than the commercial quantity and the said recovery has been made from co-accused. Learned counsel further submits that the conclusion of trial is likely to take a long time and no useful

3. Per contra, learned Public Prosecutor has vehemently opposed the bail application.

Having heard the arguments advanced by the learned counsel for the parties and considering the fact that the accused- applicant has a family to be supported; that the accused-applicant has no criminal antecedents; that the recovered contraband i.e. ganja is 1.790 Kg, which is less than the commercial quantity; that the said recovery has been made from co-accused and no recovery has been made from the accused-applicant and looking to the overall facts and circumstances of the case and material on record but without commenting on merits/demerits of the case, this court is inclined to allow the bail application of the accused- applicant and enlarge him on bail.

Accordingly, the bail application under Section 483 BNSS is allowed and it is ordered that accused-applicant Gaurav Sharama @ Bablu Sharma S/o Shri Ganesh Sharma, shall be enlarged on bail provided he furnishes a personal bond of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of learned trial Judge for his appearance before the court concerned on all the dates of hearing as and when called upon to do so.
