3. By means of the present writ petition, petitioners seek quashing of FIR dated 04.06.2026 registered as FIR No. 213 of 2026 under Section 111, 3(5), 318(4), 336(3), 338, 340, 61(2) of BNS, registered at Police Station-Kashipur, District Udham Singh Nagar.
4. Learned State Counsel have submitted that investigation in the matter is still going on and several persons are involved in it and S.T.F. is seized with the matter. It is further submitted that investigation is going on in the State of U.P. also and any interference at this stage by this Court would hamper the investigation.
5. Heard learned counsel for the parties and perused the record.
6. This Court finds some force in the submission of learned State Counsel.
7. This is a petition under Article 226 of the Constitution of India seeking direction that petitioners may not be arrested pursuant to FIR in question. Such a direction is not issued generally, if FIR discloses commission of offences and this case involves the operation of racket of illegal issuance of arms license.
8. As stated, in the instant case, FIR discloses commission of offence, which is
under investigation. Hence, at this stage, no interference can be made and the writ petition deserves to be dismissed.
9. Accordingly, the present writ petition is dismissed.
