HC-KAR NC: 2026:KHC:10589 WP No. 2849 of 2026
CORAM: HON'BLE MR. JUSTICE S.R.KRISHNA KUMAR ORAL ORDER This petition by the plaintiff in O.S.No.5620/2025 is
directed against the impugned order dated 14.01.2026, whereby the trial Court refused to extend the ad-interim ex-parte order of temporary injunction passed in favour of the petitioner/plaintiff and adjourned the matter to 11.03.2026.
2. Heard learned counsel for the petitioner and learned counsel for the respondent and perused the material on record.
3. When the matter came up before this Court on 31.01.2026, the following interim order was passed:
"Issue emergent notice to the respondent, returnable by 20.02.2026. Meanwhile, interim order dated 05.08.2025 passed by the trial Court in O.S.No.5620/2025 by the XX Additional City Civil Judge, Bengaluru will remain in force and operate between the parties, till next date of hearing. Liberty is reserved in favour of respondent to seek vacation/modification of this order."
4. It is an undisputed fact that I.A.No.1/2025 for temporary injunction filed by the petitioner is pending

consideration before the trial Court and the respondent would file their objections on the next date of hearing of the suit, which stands posted to 11.03.2026.
5. Under these circumstances, though several
contentions have been urged by both sides in support of their respective claims, without expressing any opinion on the merits/demerits of the rival contentions, I deem it just and appropriate to dispose of this petition by issuing certain directions to the parties and to the trial Court.
6. In the result, the following:
ORDER i) Petition is hereby disposed of. ii) The respondent/defendant is directed to file written statement and objections to I.A.No.1/2025 on 11.03.2026. iii) The trial Court shall consider and pass appropriate orders on I.A.No.1/2025 within a period of one month from 11.03.2026. It is further
directed that till disposal of I.A.No.1/2025 by the trial Court, as stated supra, the interim order dated 05.08.2025
