JUSTICE ROBIN PHUKAN ORDER 27.05.2026 Heard Mr. A.J. Saikia, learned counsel for the applicant and also heard Mr. N. Debnath, learned counsel appearing for the opposite party No.1. This interlocutory application under Order XLI Rule 5 read with Section 151 of the Code of Civil Procedure is preferred by the applicant for staying the operation of the impugned judgment and award dated 07.02.2026, passed by the learned Tribunal, Motor Accident Claims Tribunal (MACT) No.3, Kamrup(M), Guwahati, in MAC Case No.1176/2019 till disposal of the connected appeal. Mr. Saikia submits that the connected appeal has already been admitted for hearing and the record has also been called for from the learned Tribunal and as such, there is a requirement for staying the operation of the impugned judgment and award till disposal of the appeal. The learned counsel appearing for the opposite party No.1 submits that he has no objection, in staying the impugned judgment and award by directing the applicant to deposit 50% of the awarded amount before the Registry of this Court, however, he submits that on such deposit being made, the opposite party No.1 may be allowed to withdraw the same on proper identification and verification of relevant documents. Prayer is allowed. Accordingly, taking note of the submission of learned counsel for both the Page No.# 3/3 parties, this interlocutory application is allowed. Operation of the judgment and award, dated 07.02.2026, stands stayed till disposal of the connected appeal, subject however, to depositing of 50% of the awarded amount by the applicant before the Registry of this Court, within a period of 6(six) weeks from today.
