AD 108 April 6, 2026 Ct. 28 SG CRM(A) 719 of 2026 Reject An application for anticipatory bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Singur P.S. Case No.71 of 2018 dated 01.03.2018 under Sections 143/341/325/326/307/354/354(B)/504/506/509 of the IPC. And In the matter of: Sanjoy Dhara alias Sanjay Dhara … petitioner Mr. Suman Chakraborty Ms. Monisha Joshi … for the petitioner Mr. Sanjay Bardhan Mr. Subhajit Chowdhury … for the State Learned counsel for the petitioner submits that the petitioner did not know that his name would appear in the charge-sheet. That is why he did not take any steps earlier. The petitioner has been falsely implicated in this case. Learned counsel for the State opposes the prayer for anticipatory bail, refers to the injury report which shows cut injuries on both wrist joints. He also refers to the statements of witnesses and the FIR which specifically named the petitioner as one of the assailants. The FIR maker was an eyewitness. Moreover, the petitioner has remained absconding since 2018, the year in which the FIR was registered. Charge-sheet has been submitted. Considering the above, the other incriminating materials available in the case diary and the fact that the petitioner 2 has remained absconding for so long, I do not consider this to be a fit case for granting anticipatory bail. The application for anticipatory bail is, thus, rejected. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of requisite formalities.
