Also heard Mr. P Borthakur, the learned Additional Public Prosecutor appearing for Page No.# 2/2 the State of Assam as well as Mr.B Phukan, the learned counsel appearing for the respondent No.2. 2. This is an application under Section 483 of the BNSS, 2023, whereby the petitioner Bagan Tayung has prayed for releasing him on bail, after he was arrested in connection with POCSO Case No.81/2025 (corresponding to G.R. Case No.242/2025) pending in the Court of the learned Special Judge (POCSO), Lakhimpur, North Lakhimpur. 3. In this case, the victim girl and her mother were examined by the trial court. Both of them became hostile and failed to adduce evidence. 4. The petitioner Bagan Tayung has been in custody since 15.03.2025. 5. I have considered the submissions made by the learned counsel of both sides. 6. Under the given circumstances, this Court is of the opinion that the petitioner no longer deserves to be detained in custody. Therefore, his bail application is allowed. 7. I have considered the submissions made by the learned counsel of both sides. 8. The petitioner Bagan Tayung is allowed to go on bail of Rs.25,000/- (Rupees Twenty Five Thousand) with a surety of like amount to the satisfaction of the learned Special Judge (POCSO), Lakhimpur, North Lakhimpur. 9.
