G.P. for Revenue The Court made the following: 2 BSB,J W.P.No.18378 of 2026 ORDER: The writ petition is filed under Article 226 of the Constitution of India, seeking the following relief: “…to issue an order, writ or direction, more particularly in the nature of Writ of Mandamus, questioning the action of the respondents in seeking dispossession of the petitioner from her property an extent of Ac. 4.45 cents in Sy. No. 470 situated at Hemavathi Village, Amarapuram Mandal, Sri Satya Sai District, (erstwhile Anantapur District) without following any procedure under law and without issuing any notice or any proceeding as illegal, arbitrary and against the principles of natural justice and violative of Articles 14, 21 and 300-A of the Constitution of India and consequently direct the respondents not to dispossess the petitioner from the above said property without following due process of law and pass…” 2. The case of the petitioner, briefly stated, is as follows: The petitioner is the absolute owner and possessor of the subject land. It was inherited by the petitioner from her ancestors and her name was mutated in the revenue records. While things stood thus, the staff of the respondent No. 4 came to the subject land on 02.07.2026 and measured it and directed the petitioner to handover the possession of the property due to political reasons, without issuing any notice. Hence, this writ petition was filed. 3. Sri G. Divyatheja, learned Assistant Government Pleader for Revenue placed on record a copy of written instructions of the respondent No. 4 vide Rc.No.B / 240 / 2026, dated 07.07.2026, wherein it is stated as below: 3 BSB,J W.P.No.18378 of 2026 Originally, the land in Sy.No. 470 Ext Ac. 9.90 cents was classified as G.D. patta land as per R.S.R. recorded in the name of Banageri Obala Giriyappa. Further, as per webland adangal of Hemavathi village, the subject land is recorded as follows; Sl. No. Sy.No. Extent Name of the Pattadar 1B Khata Land nature 1 470 4.45 Nagaveni W/o. N. Badavaiah 2227 Patta Land As seen from the webland history of the above Sy. No. it is observed that the above survey No. 470 ext 4.45 cents are auto mutated at the sub-register Madakasira on 25.07.2024 for which his authority is no way concerned for the auto Mutation activity. Further, as seen from para No. 6 of the affidavit copy, the petitioner alleged that the staff of this office are trying to dispossess her without following due procedure of law. In this connection, this authority or staff of this office have never entered into the property of the petitioner and never tried to dispossess her and also not even issued notice to the petitioner and also the petitioner has never approached this office at any point of time to resolve her problem. 4. Basing on the written instructions, the learned Assistant Government Pleader for Revenue submitted that there was no alleged interference with the possession of the petitioner’s property. 5. In view thereof, the learned counsel for the petitioner requested to dispose of the writ petition recording the written instructions as part of the order. 6.
