02/ 17.04.2026: Heard learned counsel for the petitioner and learned counsel for the State.
2. The petitioner is apprehending his arrest in connection with Belbadda P.S. Case No. 77/2025, registered under sections 274, 275 of the BNS and section 47 (a) of Excise Act, pending in the Court of learned S.D.J.M, Godda.

Learned counsel for the petitioner submits that the scooter is in the name of petitioner however, allegations are made that certain quantity of liquor was recovered from the said scooter. He next submits that the petitioner is labourer and at the alleged date of occurrence the petitioner was working in the State of Gujarat. He further submits that petitioner has got no criminal antecedent which is disclosed in para 14 of the petition. On these grounds, he submits that the petitioner may kindly be provided privilege of anticipatory bail.

Learned counsel for the State opposes the prayer and submits that from the said scooter liquor has been recovered.

Considering the quantity of liquor and further considering that petitioner was discharging his duty in the State of Gujarat and he has got no criminal antecedent which is disclosed in para 14 of the petition and in that view of the matter, petitioner is directed to surrender before the learned court within two weeks from today and the learned court shall release the

petitioner on terms and conditions and sureties as learned court deems fit and proper.
6. This anticipatory bail application is disposed of.
