3. Petitioner was appointed as Lecturer in a Government Intermediate College in District Chamoli in the year 1996. Thereafter he was transferred to Government Inter College, Kelakhera, District Udham Singh Nagar in the year 2000 where he served till 2015. He was then promoted as Head Master in Government Higher Secondary School, Basai where he served till 2021. He was thereafter transferred as Principal, Government Inter College, Kunda, District Udham Singh Nagar in 2021. Petitioner thereafter was transferred as Principal, Government Inter College, Reethakhal, Champawat, vide order dated 25.06.2023, which is challenged in this writ petition. Challenge to the transfer order is only on the ground of illness of petitioner as well as his daughter.
4. It is contended that both petitioner and his daughter are undergoing treatment in different hospitals and his transfer from Udham Singh Nagar to Champawat would

5. Co-ordinate Bench, vide order dated 12.07.2023 had directed for constitution of State Medical Board, which was to examine medical condition of the petitioner.
6. Learned State Counsel submits that he has no instructions as regards constitution of Medical Board or report, if any, submitted by the Board.
7. Since nearly three years have gone by, therefore, no useful purpose would be served by keeping this writ petition pending.
8. The writ petition is, accordingly,
disposed of by directing the Competent Authority to take decision regarding petitioner’s transfer in the light of report of the Medical Board, if Medical Board has submitted report. In case Medical Board has not submitted report so far, then petitioner shall be asked to appear before the Medical Board within fifteen days and based on the opinion given by Medical Board, Competent Authority shall take decision regarding petitioner’s transfer, within two weeks thereafter. For a period of two months or till decision by the competent authority, whichever is earlier, status quo qua petitioner’s posting shall be maintained.
