Judgment / Order 17/04/2026
1. The present writ petition has been filed assailing the order dated 22.03.2024, passed by learned Senior Civil Judge cum Additional Chief Judicial Magistrate, Gangapur City, in Civil Case No. 08/2020, whereby the application of the plaintiff-petitioner under Section 65 of the Indian Evidence Act, 1872 has been rejected.
2.
Learned counsel for both the parties fairly submit that the controversy involved in the present writ petition has already been settled by this Court in the judgment rendered in a bunch of case led by Kamlesh & Ors. vs Pappu Saini & Ors.; S.B. Civil Writ Petition No.17903/2025 (decided on 10.04.2026). The relevant paragraph of the Kamlesh (supra) reads as under:-
"27. In view of the above discussion, this Court is of the considered opinion that an insufficiently stamped document is inadmissible in evidence unless proper stamp duty and penalty are paid. Such a document cannot be admitted even in the form of secondary evidence to bypass the statutory bar. Further, the photocopy
[2026:RJ-JP:16294] (3 of 3) [CW-7062/2024] document cannot be impounded under the 35 of the Act of 1998 by the Court."
3. Considered.
4. In view of the judgment passed in the case of Kamlesh (supra), this Court finds no error in the impugned order dated 22.03.2024, so as to warrant interference in exercise of its supervisory jurisdiction under Article 227 of the Constitution of India. Accordingly, the present civil writ petition is dismissed.
5. Pending application(s), if any, also stands disposed of.
