2. According to petitioner, he purchased a piece of land admeasuring 0.0398 hectare situate in Village Gadarjudda, Pargana Manglaur, Tehsil Roorkee, District Haridwar by a registered sale deed executed on
02.01.2009.

It is further his case that, at the time of purchase of said land, the village was under consolidation operation and petitioner was ultimately allotted chak in Khata No. 338 by Consolidation Officer which attained finality, but petitioner has not been handed over physical possession of the chak, allotted to him.
4. By means of this writ petition, petitioner has sought the following relief:
“i. Issue a writ, order or direction in the nature of mandamus commanding/directing the respondents to handed over the possession of the land earmarked by weay of police force and administrative force (both chakbandi and Tehsil staff) for the petitioner and /or to direct the respondents to consider and decide the
2026:UHC:4666 application/representation dated 20.03.2026 (contained as Annexure no. 6, page no. 39 to 40 to this writ petition.”

Learned counsel for the petitioner drew attention of this Court to letter dated 22.11.2016, issued by Settlement Officer, Consolidation to Sub Divisional Magistrate, Roorkee, which is on record as Annexure-5 to the writ petition. By said letter, Sub Divisional Magistrate was requested to depute Tehsil employees, who may visit the spot with employees of Consolidation Department for measurement of the land in question. He submits that there is no progress in the matter thereafter.
6. Learned State Counsel was given time to get instructions. On instructions, he submits that consolidation operations were concluded on 20.09.2016, and entire record has now been sent back to Tehsil concerned.

Learned counsel for the petitioner submits that District Magistrate, who also happens to be Deputy Director of Consolidation, may be directed to pass necessary order.
8. Accordingly, the writ petition is
disposed of with liberty to petitioner to make representation to District Magistrate. If
2026:UHC:4666 petitioner makes representation to the District Magistrate within two weeks, District Magistrate concerned shall look into the matter and pass necessary order, as per law, within six weeks thereafter.
9. It goes without saying that other persons who have interest in the matter shall also be given opportunity of hearing by District Magistrate while passing the order.
