------
CORAM: HON’BLE MR. JUSTICE ANIL KUMAR CHOUDHARY
------
For the Petitioner : Md. Shakil Ansari, Advocate For the State
: Mr. V.K. Vashistha, Spl. P.P. ------
Order No.02 Dated- 18.04.2026
Heard the parties.
The petitioner has moved this Court for grant of bail in connection with C.I.D. P.S. Case No.33 of 2025 registered for the offences punishable under sections 126(2), 127(1), 121(1), 121(2). 111, 132, 109, 317(5) & 3(5) of the B.N.S., 2023 and under Section 25(1-b)a/26/27 of the Arms Act.
The learned counsel for the petitioner submits that the allegation against the petitioner is that the petitioner in furtherance of common intention with the co-accused persons attempted to murder the police personnel by firing upon them. It is also alleged that the petitioner is an active member of organized gang of criminals namely Sujit Sinha Gang. It is next submitted that the apart from this case, the petitioner is also involved in two other cases as mentioned in para -18 of the bail application. It is then submitted that the petitioner has been in custody since 13.10.2025 as has been mentioned in para-14 of the bail application. It is further submitted that the allegations against the petitioner are all false. Hence, it is submitted that the petitioner be admitted to bail.
The learned Spl. P.P. on the other hand vehemently opposes the prayer for bail and submits that keeping in view the fact that the petitioner is member of member of organized gang of criminals namely Sujit Sinha Gang and attempted to murder the police personnel by firing upon them, as also in view of his criminal
antecedent, there is every chance of the petitioner absconding and tampering with the evidence, if released on bail. Hence, it is submitted that the petitioner ought not to be admitted to bail.
Considering the serious nature of allegation against the petitioner and the chance of his absconding and tampering with the evidence, if released on bail, this Court is not inclined to admit the petitioner on bail.
Accordingly, the prayer for regular bail of the above-named petitioner is rejected.
