JUSTICE M.NAGAPRASANNA ORAL ORDER The petitioners are before this Court, seeking the following prayers: “WHEREFORE, the Petitioners-Accused Nos.1 to 3 above named most humbly pray that this Hon'ble Court may be pleased to: Quash the proceedings in C.C. No. 3961/2024 on the file of the Hon'ble II Additional Civil Judge and JMFC Devanahalli arising out of Crime No. 127/2024 of Vijayapura Police Station Devanahalli for the offences punishable under Sections 115(2) 118(1) and 352 read with Section 3(5) of the Bharatiya Nyaya Sanhita in the interest of justice. And grant such other relief or reliefs as this Hon'ble Court deems fit in the facts and circumstances of the case.” 2. Heard Sri.Tejas N, learned counsel appearing for the petitioners, Smt.Sowmya R, learned HCGP appearing for respondent No.1, Sri.Tejash P, learned counsel appearing for respondent No.2 and have perused the material on record. 3. During the subsistence of the proceedings, the parties to the lis have entered into a settlement and have settled the dispute by filing Compounding Application along with affidavit and Joint Memo drawing up certain terms of - 4 - HC-KAR NC: 2026:KHC:14459 CRL.P No. 3752 of 2026 settlement. The Joint Memo filed by the parties to the lis reads as follows: “The Petitioners and Second Respondent have mutually agreed to compound the offenses alleged in the charge sheet in C.C. No: 3961/2024. On the file of Hon'ble II Additional Civil Judge and JMFC, Devanahalli Bengaluru Rural which is arising out of Crime No: 127/2024 of Vijayapura Police Station, Bengaluru Rural for offenses under Sections 115(2), 118(1), 352, read with Section 3(5) of B.N.S., The Second Respondent without any conditions of their own accord have come forward to compound the offenses alleged against the petitioners herein. Consequently, the second respondent is consenting for quashing of the proceedings against the petitioners in C.C. No: 3961/2024. On the file of Hon'ble II Additional Civil Judge and JMFC, Devanahalli Bengaluru Rural which is arising out of Crime No: 127/2024 of Vijayapura Police Station, Bengaluru Rural as continuation of the same would amount to an abuse of process of law and such quashing is necessary to secure the ends of justice.” 4. The parties to the lis are present before this Court and are identified by their respective counsels. 5. In the light of application for compounding being filed along with the Joint Memo and offences not being against the State, I deem it appropriate to accept the compounding application and terminate the proceedings against the petitioners in the subject petition. - 5 - HC-KAR NC: 2026:KHC:14459 CRL.P No. 3752 of 2026 6. For the aforesaid reasons, the following: O R D E R [I] Criminal Petition is disposed. [II] Proceedings in C.C.No.3961/2024 pending before the II Addl.
