Order No.
ORDER 03.02.2026
01. 1. Heard learned counsel for the respective parties. 2. Instant petition under Section 482 BNSS is filed seeking pre-arrest bail of the petitioner in connection with G.R Case No.2465 of 2025 pending in the file of learned SDJM, Kendrapara arising out of Kendrapara Sadar P.S. Case No.580 of 2025 on the grounds stated. 3. Perused the FIR as at Annexure-1. It is submitted to the Court that the petitioner and the victim are major and both had been in a relationship and the same is revealed from the FIR i.e. Annexure-1. A copy of the receipt of their marriage issued by a temple at Kendrapara is produced by learned counsel for the petitioner to claim that such marriage between the parties was solemnized in the year 2025. The Court finds from the FIR at Annexure-1 that the victim left her parental home, hence, the report was lodged by her father, namely, the informant. As it
appears, the parties had been in a relationship and the victim was pregnant out of such relationship. Considering the claim of the marriage, referring to a receipt of the temple at Kendrapara, the fact that it had taken place after a relationship between the parties, recording the objection of the State, this Court is of the view that the petitioner though not entitled to pre-arrest bail but he should be directed to surrender before the learned court below to be released on bail with suitable conditions imposed. 4. Accordingly, it is ordered. 5. In the result, the ABLAPL is disposed of with the direction as aforesaid. In the event, the petitioner surrenders before the court of learned SDJM, Kendrapara within a fortnight from today, it is directed that he shall be released on bail in connection with G.R Case No.2465 of 2025 corresponding to Kendrapara Sadar P.S. Case No.580 of 2025 on furnishing a bail bond of Rs.30,000/-(rupees thirty thousand) with one solvent surety for the like amount with such other conditions imposed by the court concerned as deemed just and proper and in the facts and circumstances of the case besides the following, such as, he shall report the I.O in the investigation as and when necessary and called upon. 6.
