Learned advocate for the petitioner submits that there has been recovery of brown sugar from the joint possession of the petitioner and the other accused. The petitioner is in custody for eight months. Learned advocate for the State submits that the subject-matter of the case relates to alleged recovery of 1.108 kg of brown sugar. Having regard to the quantum of seizure in the present case, I am of the view that the rigors of Section 37 of the NDPS Act are attracted. Hence, the prayer for bail of the petitioner is Rejected. Accordingly, CRM(NDPS) 254 of 2026 is dismissed.
