The petitioner is apprehending his arrest in connection with Garhwa P.S. Case No.572 of 2025 for the alleged offences registered under Section 64(1) of Bharatiya Nyaya Sanhita, 2023 and Sections 4 and 6 of POCSO Act pending in the Court of learned Special Judge POCSO-cum-ASJ-I-cum-FTC (CAW), Garhwa. 3. Learned counsel appearing for the petitioner submits that the petitioner has been falsely implicated in this case and the allegation is made that she was in the house of the petitioner and petitioner and girl were in love and in view of that the anticipatory bail may kindly be granted to the petitioner. 4. Learned counsel appearing for the State opposed the prayer and submits that the girl was of 16 years and the father has saw the girl in compromising position along with the petitioner in the 2026:JHHC:11266 --2-- A.B.A. No. 1762 of 2026 house of the petitioner and in view of that anticipatory bail may kindly be rejected. 5. Considering that the age of girl is 16 years and she was minor and in the house of this petitioner father has seen the girl in compromising position and in that view of the matter, I am not inclined to grant privilege of anticipatory bail to the petitioner, hence, the prayer for anticipatory bail of the petitioner is hereby rejected.
