The Court below, upon consideration of the material on record, dismissed the petition holding that the appellant had failed to establish any of the grounds warranting a declaration under Section 12 of the Hindu Marriage Act, 1955. 3. It is brought to the notice of this Court that the learned counsel for the appellant has been elevated as a Judge of this Court vide order dated 29.06.2026. Consequently, Registry was directed to issue notice to the appellant. In compliance with the said direction, notice was issued to the appellant; however, the same was returned with the endorsement, "Addressee left without instructions." 4. In view of the said endorsement, this Court is of the opinion that the appellant is no longer interested in prosecuting the appeal. 5. Accordingly, the appeal is dismissed for non-prosecution. There shall be no order as to costs.
