Learned advocates for the State as well as the private opposite party nos.2, 3 and 4 are present. The subject-matter of challenge relates to an order of bail granted on 02.09.2023 by the learned Additional Sessions Judge, Kandi, Murshidabad. A report has been submitted by the learned Advocate for the State. The report speaks that out of the 26 charge-sheeted accused persons, 24 accused persons are on court bail and two of the accused persons are absconding. Having considered that the bail was granted on 02.09.2023 and more than two years six months have passed since then as also the report which do not reflect that the post- bail conduct relates to any misuse of the liberty, I am not inclined to interfere with the prayer for cancellation of bail granted on 02.09.2023. 2 However, if the learned trial court at any relevant stage finds that the accused persons are creating obstruction in the progress of the trial and/or are involved in tampering with the witnesses, it would be the discretion of the learned trial court to take an appropriate action against the concerned accused who is involved in such overt acts. The learned trial court at that stage would be at liberty to pass any order(s) and/or cancel the bail which is being enjoyed by the accused persons. With the aforesaid observations, CRM (DB) 3754 of 2023 is dismissed. Two report submitted by the State be kept with the record.
