JUSTICE B M SHYAM PRASAD ORAL ORDER The petitioner, a Society registered under the Karnataka Societies Registration Act, 1960, is aggrieved by the second respondent's order dated 17.05.2024 [Annexure - M] and the petitioner's grievance is because the second respondent has appointed the Election Officer to conduct the elections. This Court, on 21.01.2026, recording the respondents' case that elections have not been scheduled though the previous election was held in 2019 [sic] for constitution of a Committee, has called upon the petitioner to place on record when the - 4 - HC-KAR NC: 2026:KHC:10706 WP No. 13497 of 2024 elections will be held. The Managing Committee's tenure is only for two years. Ms. Gowhar Unnisa, the learned counsel for the petitioner, has placed on record a Communication dated 05.02.2026 which reads that the Managing Committee has decided to appoint an Election Officer and that the election would be completed before 31.03.2026. Ms. Gowhar Unnisa submits that the petition could be disposed of in the light of this Communication, and Mr. V. D. Raviraj, the learned counsel for the fifth respondent, submits that the petition indeed could be disposed of in these terms but this Court must observe that no Annual General Body Meeting can be called until the elections are held because the present Managing Committee notwithstanding the circumstances, has called for Annual General Body Meeting on 22.02.2026. The controversy presented stands closed with the petitioner stating that the Election Officer would - 5 - HC-KAR NC: 2026:KHC:10706 WP No. 13497 of 2024 be appointed and elections will be held before 31.03.2026, and insofar as the proposed General Body Meeting scheduled to be held on 22.02.2026, this Court must observe that such meeting cannot be because the Managing Committee's tenure has expired and the next elections are scheduled to be completed before *31.03.2026.
