These instant bail applications under Section 483 B.N.S.S. have been filed by the petitioners in connection with the impugned FIR No. 373/2025 registered with the Police Station Sadar Bundi, District Bundi for the offences punishable under Section(s) 318(4), 316(2) & 61(2) B.N.S., 2023. Learned counsel for the petitioners submits that the allegations levelled in the impugned FIR against the petitioners indicate that they took the tractor-trolleys of the complainant in order to use the same in the factory for gainful purposes on payment basis, but instead of doing so, his tractor-trolleys were being kept with the co-accused Ladu Singh and amount towards uses was not paid to the petitioners. 3. Counsel submits that the tractor-trolleys have already been recovered from the co-accused Ladu Singh and he has already been granted indulgence of bail. He further submits that the alleged offences are triable by Judicial Magistrate and after investigation charge-sheet has been submitted against the petitioners. The petitioners are in custody since 07.11.2025 and the trial will take its own time to conclude, therefore, indulgence of bail may be granted to the petitioners. 4. Per contra, learned Public Prosecutor opposes the bail applications and submits that the petitioners are habitual offenders and 14 other cases are lying pending against accused- petitioner-Naresh Kumar and one case is pending against the accused-petitioner-Shabir. Hence, under these circumstances the petitioners are not entitled to get the indulgence of bail and their bail applications are liable to be rejected. 5. Heard and considered the submissions made at Bar and perused the material available on record. 6. Considering the arguments put forward by counsel for the petitioners and looking to the fact that the tractor-trolleys in question had already been recovered from the co-accused Ladu Singh and since indulgence of bail had already been granted to [2026:RJ-JP:12943] (3 of 3) [CRLMB-2882/2026] him, and the petitioners are in custody since 07.11.2025, charge- sheet has already been submitted and the alleged offences are triable by Judicial Magistrate and the trial will take its own time to conclude, without expressing any opinion on merits or demerits of the case, this Court deems it just and appropriate to grant indulgence of bail to the accused-petitioners under Section 483 BNSS. 7. Accordingly, the instant bail applications under Section 483 B.N.S.S. are allowed and it is ordered that the accused-petitioners Naresh Kumar S/o Rameshwar Lal & Shabir S/o Dinu arrested in connection with the aforementioned FIR, may be released on bail; provided both of them shall furnish personal bond of Rs.50,000/- each along with two surety bonds of Rs.25,000/- each to the satisfaction of the learned Trial Court with the stipulation to appear before that Court on all the dates of hearing as and when called upon to do so. 8. 8. It is made clear that in case the petitioners are found repeating and committing the same offence again in future, the Investigating Officer/Public Prosecutor would be at liberty to move applications for cancellation of their bail in the instant cases.
