DATE : 07.09.2026 By this petition, the petitioner is seeking directions to the respondent No. 1- Committee to decide the caste claim of the petitioner expeditiously and till then, the respondent Nos.2 and 3 shall not cancel the admission of the petitioner. 2. As per contention of the petitioner, he belongs to the ‘Mana’ Scheduled Tribe and his caste claim was forwarded for the validation on 22.07.2026. Now, he is already admitted in respondent No.3 – College in the course of B.Pharmacy, for which precondition is to produce the validity certificate. Due to the unavailability of the validity certificate, there is every possibility of Prity 2 / 3 6.wp7069.2026 cancellation of his admission. Therefore, the petitioner seeks direction to the respondent No.2 and 3. 3. We have considered the documents which are filed on record, which shows that the seat is already allotted to the petitioner in the respondent No.3 – Ravi Bahuddeshiya Shikshanik Sanstha’s Sonekar College of Pharmacy, Nagpur, from the Scheduled Tribe Category. 4. As the State Government has already considered this aspect and already extended the period of producing the validity certificate within three months by issuing the Government Resolution dated 04.09.2026, but the Scheduled Tribe was excluded from above resolution. There is no reason apparent from the said Government Notification why this benefit is not extended to the Scheduled Tribe. 5. Considering the same herein in the present petition also direction can be given to the respondent No.1 to decide the caste claim of the present petitioner within six months. 6. In the meantime, the respondent Nos. 2 and 3 shall not cancel the admission of the present petitioner, if she otherwise eligible. The admission of the present petitioner is subject to the final outcome of the caste claim. The petitioner shall not seek any equity on that ground. Prity 3 / 3 6.wp7069.2026 7.
