The petitioner has been made accused in connection with Bariyatu P.S. Case No. 47 of 2025 registered for the offences punishable under Section 111(3), 111(4), 111(6), 61(2) BNS 2023 and Section 25 (1- B)a, 26, 35 of the Arms Act. It is submitted by the learned counsel for the petitioner that the allegation against the petitioner is that the petitioner along with co- accused persons assembled to commit some incident and to teach a lesson to a contractor for not supplying the revenue to him and from co-accused persons two country-made pistol were seized. It is next submitted that the allegation against the petitioner is false. It is then submitted that the petitioner has been in custody since 27.09.2025 as has been mentioned in para 14 of the bail application. It is then submitted that the petitioner has no criminal antecedent as has been mentioned in para 15 of the bail application. It is then submitted that charge-sheet has already been submitted in this case. It is then submitted that no witness has been examined in this case. It is further submitted that co-accused, with similar allegations, has already been admitted to bail by a co-ordinate Bench of this Court vide order dated 16.03.2026 passed in B.A. No. 1443 of 2026. It is next submitted that the petitioner undertakes to cooperate with the trial of the case. Hence, it is submitted that the petitioner be admitted to bail. Learned Addl. P.P. opposes the prayer for bail. Considering the facts of this case, the above-named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Latehar in connection with Bariyatu P.S. Case No. 47 of 2025 with the condition that he will co-operate with the trial of the case, furnish his mobile number and photocopy of the Aadhar Card in the court below with an undertaking that he will not change his mobile number during the trial of the case.
